PC: CrPC, IPC revamp soon
The government on Thursday announced that it had been working on a comprehensive draft document to holistically revisit the entire gamut of CrPC and Indian Penal Code (IPC).
Replying to a debate in the Lok Sabha on a bill amending the CrPC Act of 1992, home minister P. Chidambram said, “In a year or so we will be able to come out with a draft report on comprehensive revamp in the CrPC and IPC.” For the purpose, he said, he has already written to the law ministry and they are working on it.
The assurance from the home minister came following demands from the members cutting across party line that the criminal justice in the country need to be overhauled to keep pace with the changing time and suits the needs of Independent India.
Meanwhile, the Lower House passed the amendments in the CrPC, which provides a clause in dealing with cognisable offences amounting to imprisonment of less than seven years.
Presently, in such cases police may or may not arrest the accused. “In the Section 41(1) A & B there is a provision that in such cases if a policeman arrests an accuse he has to give in writing the reasons for that. Till now police has the discretion of avoiding arrests in such cases. The discretion will remain with the police, but with this amendment the police have to again give reasons for not arresting an accused,” Mr Chidambram said, while summing up the discussion.
The home minister also said, there already existed a “Model Police Act” to ensure refinement in policing in the country. “Now it is up to states to adopt it. I am pursuing with them. Unfortunately none of them adopted it till now. However, I will continue to press for it with the states,” he added.
