SC bench declines to hear Dinakaran's petition
A two judge bench of the Supreme Court on Thursday declined to hear a petition of Sikkim High Court Chief Justice P.D. Dinakaran, challenging the procedure followed by an impeachment inquiry committee against him.
Without specifying any reason, a bench of Justices D.K. Jain and H.L. Dattu declined to hear the petition when the case was mentioned before it by senior advocate and former additional solicitor general Amrendra Sharan on behalf of Justice Dinakaran.
Sources said Justice Dattu, posted in the Madras High Court before his elevation to the apex court, did not want to hear the case because Justice Dinakaran was also a judge of the Madras High Court before his elevation as Chief Justice of Karnataka High Court.
Justice Dinakaran, who was transferred to Sikkim from Karnataka after Rajya Sabha chairman and Vice-President Hamid Ansari admitted an impeachment petition against him, questioned the functioning of the panel, headed by Justice Aftab Alam of the Supreme Court.
The other members of the committee include Karna-taka High Court Chief Justice K.S. Khehar and senior advocate P.P. Rao.
