SC nod to BCI probe against Raja’s friend
The Supreme Court on Monday allowed the Bar Council of India to proceed “independently” against sacked Tamil Nadu and Puducherry Bar Council chairman R.K. Chandramohan, indicted by the Madras high court for alleged attempt to “influence” a judge at the behest of former telecom minister A. Raja in his relatives’ bail case.
While permitting the BCI to proceed further against Mr Chandramohan, a bench of Justices D.K. Jain and H.L. Dattu lifted its stay on the HC order while admitting his petition for examining a constitutional question whether the HC has power to pass an order for suspension of the chairman or a member of the bar council, a statutory body. “The BCI will take independent decision,” the top court order said while refusing to record any thing related to Mr Chandramohan’s counsel Mukul Rohtagi’s contention that his client was not debarred form contesting forthcoming Tamil Nadu and Puducherry Bar Council election in the wake of his tenure coming to an end in March. Mr Prashant Bhushan, appearing for E.G. Rajendran, took objection to recording anything about the ensuring election in the order.
