SC quashes Raje govt probe panel
Former Rajasthan chief minister Vasundhara Raje and Leader of Opposition in state Assembly got a major relief from the Supreme Court on Monday as it refused to intervene in the state HC order quashing the setting up of inquiry commission to probe corruption allegations against her.
The commission, headed by Justice N.N. Mathur was set up by the Congress government, headed by Ashok Gehlot government in January 2009 to go into the alleged misuse of the power by the former CM during her tenure and in the process causing huge financial loss to the state due to the “wrong” decisions.
However, a bench of Justices D.K. Jain and H.L. Dattu rejected a petition of the Rajasthan government challenging the state HC order quashing the appointment of Justice Mathur panel.
The HC had set aside constitution of the commission and directed that all the complaints against the previous government should be referred to the Lokayukata.
The state government challenged the HC order of January 2010 on the ground that the judicial probe by a multi-member commission, would give credence to the inquiry and expedite the probe.
The state government also had raised the question on the “locus standi” of two individuals — Kashi Purohit and Krishan Murarilal Asthana — challenging the setting up of the commission in the HC, saying their action in fact was “politically motivated”.
However, the apex court found no merits in the plea of the state government had rejected it while accepting the HC order that Lokayukta was the right forum to probe any charge of corruption against any government functionary.
