SC rejects PIL on ‘socialism’ clause
A Supreme Court bench headed by Chief Justice S.H. Kapadia on Monday dismissed a PIL challenging the requirement for political parties to swear by “socialism” while registering, though it acknowledged the importance of the issue and promised to “take it up only when situation so arises”. No political party has so far questioned this.
The inclusion of “socialism” in Preamble of the Constitution through the 42nd Amendment during the 1975-77 Emergency was also challenged by an NGO, with senior advocate Fali S. Nariman arguing this “insertion” was “basically wrong”.
