SC tightens noose on tinted glass
While monitoring the implementation of its order on removal of black films from all vehicles across the country in the wake of such vehicles being used for serious crimes, the Supreme Court on Friday issued a threat of initiating contempt proceedings against DGPs of the states and police commissioners of big cities for their failure to implement the order.
The stern warning came from a bench of justices B.S. Chauhan and Swatanter Kumar, which earlier had passed an order declaring pasting of black films in the vehicles as violation of the Motors Vehicle Act and the rules framed under it.
“We are not only emphasising on security threat to nation but it is a clear violation of law. No material can be pasted on safety glasses and the law needs to be enforced,” the top court made clear to counsel representing different states, which failed to submit the compliance reports.
“DGPs/CPs must ensure compliance in letter and substance. At this stage, we will not initiate any action on the DGPs and other officials but issue a clear warning that in case of non-compliance of the order, the court shall be compelled to initiate appropriate action under the contempt of courts act without any notice,” the bench said.
The Friday warning came as a follow up of the July 22 direction of the apex court when it had expressed “dissatisfaction” over tardy implementation of its judgement banning the use black films in the vehicles.
The apex court had said that the Motor Vehicle Act only permits tint in the front and rear screen and side glasses only if it was in-build at the time of manufacturing.
