Setback for Ghai in Haryana too
In yet another embarrassment for filmmaker Subhash Ghai, the Punjab and Haryana High Court on Tuesday stayed the execution of sale deed of 20 acres of land purchased by his company Mukta Arts from a Panchayat of Badhsa village in Jhajjar district.
The bench has issued notices to Subhash Ghai, the Haryana government and deputy commissioner (DC) Jhajjar, directing them to respond the contentions raised in the petition. The case will be heard on July 31.
The stay orders were passed by the HC after taking into cognisance a petition alleging favour by the Haryana government in granting permission to sell village common land to the company for public purpose whereas the same was being used by Subhash Ghai for private purpose.
The division bench comprising acting Chief Justice M.M. Kumar and Justice Alok Singh has issued the orders while hearing a petition filed by a retired teacher, Nafe Singh, 70. from Badhsa village of Jhajjar in Haryana.
The petition challenged the action of the Haryana government for selling village land allegedly in gross violation of rules and without any public purpose.
The petitioner contended that the decision to sell the village land to Mukta Arts by the village panchayat was taken under pressure.
The petitioner referred to the Bombay High Court order, in February this year, which cancelled the allotment of 20 acres land to the film-maker at Goregaon by Maharashtra government in a similar manner.
That allotment was subsequently struck down by the court.
