Sex with girl below 18 is deemed rape
With the government notifying rules under the Protection of Children from Sexual Offences Act 2012, any sexual encounter with a person below 18 will be deemed rape whether it is with or without consent.
Till now, sexual offences were covered under different Sections of the Indian Penal Code. The new law was passed in May 2012 to strengthen legal provisions for the protection of children from sexual abuse.
The act has precise definitions for different forms of sexual abuse. It provides for stringent punishment, graded according to the gravity of the offence, up to rigorous imprisonment for life for certain offences, and a fine. The amendment is in consonance with the country's commitments towards the Juvenile Justice Act, 2000.
