State not to appeal on Enrica Lexie settlement

In the wake of the Italian representatives’ submission before the Supreme Court that they wanted to make necessary amendments to the agreement signed with the victims of the Enrica Lexie firing, and that they are willing to cancel the agreement, the state has decided not to file an appeal against the agreement before Kerala High Court.

According to advocate-general K.P. Dandapani, as the apex court had recorded the submissions of Italy, there was no need to file an appeal against the agreement. He added that the submission itself is favorable for the state.

The state, during the trial of the Italian’s plea seeking release of the vessel, had argued against the conditions of the agreement.

The state’s legal team headed by Gopal Subrahmaniam had argued that each clause and condition in the agreement is arbitrary and should be cancelled. The court also flayed Italy for arriving at such an agreement.

Meanwhile, counsel for the boat owner Freddy, rubbished the reports that he is planning to move the High Court against the agreement.

Adv Raja Vijaayraghavan told DC that there is no need to challenge the agreement. “We got the compensation we deserved and the agreement is not valid in criminal cases pending before the court,” he added.
