Swamy moves SC against Sibal
Former law minister and Janata Party president Subramanian Swamy on Friday moved a fresh petition in the Supreme Court accusing the new communications minister Kapil Sibal of “interfering and prejudicing” the CBI probe into the 2G scam case even when it was being directly monitored by the Supreme Court.
Mr Swamy, who filed a fresh petition after the court had allowed amendment in it during the January 10 hearing to include the names of 11 telecom companies as respondents after he sought cancellation of their 2G licences.
While seeking a court direction to the government to restrain its functionaries from making any “public comments” about the case, Mr Swamy alleged that Mr Sibal by openly criticising the CAG in a recent press conference had sought to not only “obstruct” the CBI investigation but cause “prejudice” when the matter is pending in the court.
Mr Sibal in his press conference had questioned the CAG report projecting the loss of `1.76 lakh crore to the government and claimed that the calculations of the national auditor was wrong.
Since the top court on the “criminal culpability into the 2G spectrum scam had specifically directed that the CBI take the CAG Report as a basis, hence it is apprehended that this ‘intemperate and uncalled’ for public attack on the CAG before the national press and the consequent extensive media publicity, may prejudice the investigations and cause an obstruction into the justice,” Mr Swamy said.
