Swamy wants Karuna named co-accused
Janata Party chief Subramanian Swamy on Saturday pleaded for continuance of his complaint against former telecom minister A. Raja in the 2G spectrum case before a Delhi court, which asked him whether there can be “parallel proceedings” in a criminal case, when the CBI was taking action and investigating the matter against the accused persons at present.
After the arrest of former telecom minister Raja by the Central Bureau of Investigation, Mr Swami pleaded before the court that his complaint has the wider dimension of national security.
He also intended to file an application seeking impleadment of Tamil Nadu chief minister M. Karunanidhi as an accused in his complaint.
Dr Swamy was responding to a query of Special Judge Pradeep Chaddah as how parallel proceedings can continue on the same issue when “media reports” suggested that the CBI was probing the case and has also arrested Raja and two other top officials in the case.
Dr Swamy, during the arguments, said, the scope of the private complaint was much wider than what is being investigated upon by the CBI and as per my knowledge, the complaint also involves concerns of national security and involvement of the Tamil Nadu chief minister Karunanidhi.
The court said, “As per section 210 of the CrPC, when it appears to the magistrate that the police (CBI) investigation is in progress in relation to some matter, the complaint case, which is pending before him, then he must stop the proceedings and call for reports.”
After hearing the arguments of Dr Swamy, the special judge said, “I am of the opinion that this court should not proceed for the time being with this matter,” and asked the probe agency to file a detailed report on February 22.
Meanwhile, Comptroller and Auditor General (CAG) Vinod Rai, who was earlier summoned by the special judge to appear before it as a witness in the case on Dr Swamy’s complaint, on Saturday filed a certified copy of the entire report concerning the matter through his advocate Sandeep Sethi.
The court had earlier held that the private complaint filed by Dr Swamy is maintainable.
