Take cop help for Tiwari sample: court
The Delhi high court on Wednesday directed its registrar to use police assistance to collect blood sample from veteran Congress leader N.D. Tiwai for conducting a DNA test to determine the paternity suit filed against him by a youth.
The court also came down heavily on the counsel of 86-year-old Tiwari when he sought an adjournment of hearing on the ground that a petition has been filed in the Supreme Court on the issue.
Justice Khetrapal said the various judgments delivered earlier by the Delhi high court and the Supreme Court have made it clear that pendency of a special leave petition in the Supreme Court will not come in way of the proceedings of the case.
“Joint registrar shall be entitled to avail police assistance in case the defendant number one (Mr Tiwari) is not available within the jurisdiction of this court. The JR shall seek the police assistance for bringing him in this court for the purpose of taking the blood sample for the DNA test,” Justice Khetrapal said.
The court fixed the matter for further hearing on May 21 before the joint registrar.
