Top court questions CBI’s U-turn
Taking note of strong arguments by the counsel for city dentist couple Rajesh Talwar and Nupur Talwar accusing CBI of “planting” stories in media about their “involvement” in the murder of their daughter Aarushi and domestic help, the apex court agreed to examine the validity of the trial court over converting the agency’s closure report into the chargesheet against them.
While questioning the CBI how it got fresh evidence against Dr Talwar and his wife, a bench of Justices B. Sudhershan Reddy and S.S. Nijjar fixed July 12 for detailed hearing after their counsel Harish Salve said he wanted to argue on merits to question the validity of the Ghaziabad special judge’s order converting Central Bureau of Investigation’s closure report into chargesheet. Mr Salve alleged that the CBI neither had collected any fresh evidence against Talwars, nor had it done any further investigation but only “filled the gaps” by including in the closure report some statements of witnesses recorded by previous team of the CBI.
As Mr Salve accused the CBI of “deliberately planting stories in media to prejudice” the case against Talwars every time when the case was listed for hearing in any court as was evident “during the past three days”, the bench put certain sharp queries to the agency.
“From where the CBI has become so active? You filed the documents pages after pages in the trial court submitting that there is nothing against them (Talwars). Now how could you assume that there is evidence against them? Is it merely because the trial court has taken cognisance (of closure report),” the bench asked.
