YSR Congress chief Jagan summoned
The CBI principal special judge court issued summons to Mr Y.S. Jagan Mohan Reddy and 12 others, asking them to appear before the court on May 28.
The court took cognisance of the CBI’s first chargesheet in the case that was filed on March 31. Though the court issued orders a week ago, the matter came up only on Monday. Principal special judge A. Pullaiah took cognisance of the case before going on leave.
The chargesheet deals with the government offering land and SEZ plots to Aurobindo Pharma, the Hetero group and Trident, which in turn invested in Jagati Publications and Janani Infrastructure of Mr Jagan Mohan Reddy.
Among others, summons were issued to Mr Jagan’s auditor Vijay Sai Reddy, Hetero director M. Srinivas Reddy, Aurobindo’s Nitya-nanda Reddy and B.P. Acharya of APIIC.
Summons were issued to P. Sarath Chandra Reddy of Trident Pharma, APIIC general manager (projects) Y. Vijaya Lakshmi Prasad, Aurobindo company secretary P.S. Chandra Mouli, Jagati Publications, Janani Infrastructure represented by Mr Jagan; Aurobindo and Trident and Hetero represented by their directors.
The CBI alleged that Nityananda Reddy and Srinivas Reddy conspired with YSR and Mr Acharya in the allotment of 75 acres of land at the Jadcherla SEZ at Rs 7 lakh per acre, which was way below the rate fixed by the price fixation committee, thereby causing a loss of Rs 17.2 crore.
Both firms in a quid pro quo invested in firms of Mr Jagan Mohan Reddy.
Jagan’s moves
Before appearing in court, Jagan can file an anticipatory bail application. Legal experts and Jagan camp say he is unlikely to do so.
Jagan can challenge the summons in a higher court, claiming that a fit case has not been made out against him.
After appearing in special court, Jagan can take a certified copy of the chargesheet and file a quash petition in the High Court, stating no case has been made out.
He can file a petition in the CBI court pleading that the court discharge him from the case
