CH Ashokan off the hook in probe?

With the state government making no move to appeal against the high court order granting CPI (M) leader, C.H. Ashokan bail, the Special Investigation Team (SIT) probing the T.P. Chandrasekharan murder may have a difficult time questioning him.

While 12 days have gone by since the order granting him bail was passed, the state has made no attempt to appeal against it so far. Justice N.K. Balakrishnan had on July 2 granted Mr Ashokan bail in the TPC murder case considering the period of detention and other factors.

Mr Ashokan's counsel, senior advocate, M.K. Damodaran, had pointed out that no custodial interrogation had been sought for by the investigating officer in the case and this point was recorded by the court in its order on Friday.

Following the verdict, advocate general, K.P. Dandapani, had declared the state would challenge it in the Supreme Court, but so far it has made no move to do so.Also, although the state claims it has clinching evidence against Mr Ashokan in the murder case it has not placed it before the court as yet.

Meanwhile the court on Friday dismissed Mr Ashokan's bail plea in the 2009 conspiracy case against him.

The appearance of Mr Dandapani in the the TPC murder case in place of the Director General of Prosecutions has not gone down well either in legal circles or with the Special Investigation Team.
