UK citizen can meet son in Kollam, HC rules
Giving a breather to a UK-based ad film director who is in Kochi for the last four years, the Kerala high court on Monday permitted him to spend an hour with his one-year-old son who is detained by his wife’s parents.
James Robert Edward Pierce, a resident of Kochi, moved the high court alleging that his wife Anna Mathews’ parents had detained his child and wife and were refusing to let them live with him.
The petitioner, who is working as an ad film maker for several private firms including travel agencies, submitted before the court that his wife’s parents were not allowing him have the custody of his wife and son.
According to Pierce, his son born to him out of his wedlock with Anna Mathews of Kollam, is at their house in Kollam.
A division bench comprising Justice Pius C Kuriakose and Justice Babu Mathew P Joseph considered the plea asked the parents of Anna to produce the child on every Thursday at the St Antony’s Chapel, Kollam. “Pierce can spend an hour in the evening with his child,” the court made it clear.
The petitioner argued that the parents of his wife had conducted baptism of the child even without consulting him. Pierce married Anna in 2008 and have been living in Kochi for the past four years.
The court also advised the petitioner to approach the family court and file a petition to resolve the issue.
