HC: Why Rathi not dismissed?

Taking a strong exception to the non-dismissal of former ACP S.S. Rathi, convicted for killing two innocent persons in an encounter due to mistaken identity in 1997, Justice S. Muralidhar of Delhi HC sought explanation from the Union home ministry why no action was taken against the officer.
“It’s a matter of grave concern if the police officials convicted of a heinous crime are allowed to continue in service on the ground that their appeals against such conviction are pending before the superior courts.”
