Man detained over rape freed
A man, who was allegedly detained by the police for more than two days in connection with the recent Dhaula Kuan gangrape case, was on Wednesday set free after his wife approached the Delhi high court.
The police, however, maintained that the man, Niranjan Mandal, was only called for interrogation in the Dhaula Kuan gangrape case. A division bench comprising Justices Badar Durrez Ahmed and Manmohan Singh allowed Mandal to go after the SHO of Dhaula Kuan police station appeared following a court’s direction, through its standing counsel Pawan Sharma, submitted that there were 25 police teams working to trace the accused in the Dhaula Kuan rape case and Mandal was called to the police station for interrogation only but not detained or arrested.
Mandal, who had spent more than four years in jail in connection with the January 2006 Mayapuri gangrape case, was acquitted along with other accused by a Delhi court in March this year.
“This was the reason why we have picked up Mandal for questioning as to ascertain whether he or his associate could throw a light on the bizzare Dhula Kuan gangrape case,” the police told the division bench.
The bench, in an order, directed the police to serve a notice to him as and when he was required for investigation. Filing a habeas corpus petition, Mandal’s wife Saraswati alleged her husband was picked up at 11pm on November 29 and he had not returned since then.
