HC bench won’t hear Chavan plea
A division bench of the Bombay high court on Tuesday recused itself from hearing the petition by former chief minister Ashok Chavan seeking the court’s intervention in removing his name from the FIR in the Adarsh Housing Society scam case.
On Monday, Mr Chavan had a filed a petition seeking that the case against him be quashed. The case had come for mention before the division bench of Justices S.A. Bobade and R. Ketkar of the HC on Tuesday. Justice Bobade, however, recused to hear the case. “Not before us,” the division bench said. The bench, however, did not assign any reasons for recusing itself from hearing the matter.
Mr Chavan has been named as accused number 13 in the Adarsh society scam case. In the chargesheet, the former CM has been accused of granting approvals to the housing society in upscale Cuffe-Parade area as quid-pro-quo for allotment of three flats to his relatives.
According to CBI, Mr Chavan misused his official position twice — first as revenue minister and then as chief minister — to show undue favours to the society. On Monday, Mr Chavan filed a petition seeking quashing of the cheating and corruption case as far as he was concerned. However, the bench, while recusing itself, said that the petition can come before another bench in due course.
