HC grants interim relief to 265 students
In a temporary relief to about 265 medical students, the Bombay high court on Friday directed the Maharashtra University Health Sciences (MUHS) to allow these students to apply for the upcoming exams.
The issue began when in January, the Pravesh Niryantan Samiti (PNS) recommended that the Maharashtra government cancel the admission of about 265 students belonging to the medical and dental courses who were given admission in the vacancy round. Every year, the MUHS conducts the admission rounds and admits students on a merit basis. After the first two rounds, the colleges are to inform MUHS of the remaining vacancies, and are permitted to fill them. The PNS disapproved the admissions of these students from 17 medical and dental colleges on grounds of malpractices. It held that they could not take their first-year examinations in May. These students had then moved the HC, seeking that they be permitted to appear for the exams.
Advocates Vineet Naik, Sukand Kulkarni and Ashutosh Kulkarni, appea-ring for Ashiwini Rural Medical College and seven first-year medical students respectively, informed the court that the last date for submitting the examination forms was April 2.
Another set of students who are seeking admission in these colleges have mov-ed court stating that they are meritorious students and that they should be given admission instead. They stated that they should have originally been given the seat as they had better marks than those currently occupying them.
While hearing both the petitions, a division bench of Justices S.J. Vazifdar and R.Y. Ganoo granted interim relief to these students. It directed MUHS to accept their applications to appear for the upcoming examination. The bench also held that the order would apply to all students who have been prohibited from appearing for the examinations, irrespective of whether they filed a petition or not in the matter.
