HC quashes 2 externment orders
The Bombay high court has quashed and set aside two orders of the police and the state government, externing businessman Naseem Ahmed Salim Ahmed Shaikh from the city limits for two
years. The court held that the concerned authorities had not applied their mind while issuing the externment order.
While setting aside the externement order, Justices S.C. Dharmadhikari and S.B. Shukre observed on Thursday that the orders issued by the superintendent of police (SP), National Investigation Agency (NIA), and the principal home secretary of Maharashtra government, were not in keeping with the Supreme court directives.
According to Mr Shaikh, he was issued a showcause notice on March 8, 2011 by the deputy commissioner of police, asking him to explain why he should not be externed. Mr Shaikh gave a written explanation and was also present during the hearing of the inquiry against him. After the hearing, the petitioner was externed by the NIA SP through an order dated August 5, 2011, from the limits of the city and suburbs for two years.
