HC stops channel from airing Salman news
In an interim relief, the Bombay high court on Thursday restrained a television news channel from carrying any stories concerning actor Salman Khan on its channel. The court said that prima facie, the ABP News, previously known as Star News channel, had telecast defamatory allegations against the actor.
Khan had filed a defamation suit against ABP News, seeking the court’s direction to the channel to give a written apology for telecasting a news item that had allegedly defamed him. Khan had also sought the court to grant him interim relief and restrain the channel from airing any news items about him on the channel. Khan had claimed that the news being aired by the channel against him would create prejudice against him in his current case and that it was ruining his image.
While passing the order restraining the channel, Justice Kathawala accepted the arguments of Salman’s counsel. He said, “I am satisfied that the ABP News is indulging in broadcasting defamatory allegations against Salman, which are likely to prejudice him in defence to the pending proceedings before the sessions court.”
On September 28, 2002, Khan’s Toyota Land Cruiser had rammed into a bakery in suburban Bandra, which killed one and injured four pavement dwellers. In January, the Bandra magistrate court had held that the actor should be tried for culpable homicide not amounting to murder, Section 304 (2) under the Indian
Penal Code (IPC). If convicted for culpable homicide, he could be sentenced to maximum of 10 years imprisonment. Khan has challenged the lower court’s order.
