‘Lady judge should hear application’
Anita Advani, who claims to have been the live-in partner of late actor Rajesh Khanna, on Thursday, through her lawyer, sought from the Bombay high court that an application filed against her by Khanna’s wife Dimple Kapadia be heard by a woman judge.
Ms Advani’s advocate Manohar Shetty told Justice K.U. Chandiwal on Thursday that the matter was placed wrongly before the court and a court presided by a lady judge should hear it.
As per directives issued by the high court earlier, all matters pertaining to offences against women shall be heard by a court presided by a woman judge.
After the death of Khanna last year, Ms Advani had filed a case against Dimple and her family under the Protection of Women from Domestic Violence Act.
Ms Advani had said that she was Khanna’s live-in partner and was driven out of his bungalow Aashirwad when Khanna fell sick. She had then sought maintenance from Dimple and her family.
Dimple and her family had approached the high court in December last, seeking the quashing of the case.
Apart from directing the registry to place the matter before the appropriate court, the court also directed that the interim relief granted last year in the matter for stay on the summons issued by the magistrate court directing Dimple and others to remain present before it, to continue.
Incidentally, Thursday marked the late actor’s first death anniversary. Dimple’s counsel Girish Kulkarni pointed it out to the court.
