Murder accused’s bail plea rejected
Observing prima facie, it was clear that an accused was connected to the crime, the Bombay high court on Thursday rejected the bail application of a man charged for murdering his wife by setting her on fire.
A division bench of Justices V.K. Tahilramani and P.D. Kode was hearing the bail application of Bharat Mahadeo Upase, a resident of Pune, who is currently under trial for the murder of his wife Sunanda. Upase was charged with Section 302 under the Indian Penal code (IPC) for causing the death of his wife by pouring kerosene on her and setting her ablaze. The prosecution informed the court that sub-inspector A. Karpe had received information on October 9, 2008 that a woman suffering third degree burns was admitted to the Sasoon Hospital.
Mr Karpe had then questioned the victim Sunanda who was in a condition to give a statement. In her dying declaration, she informed Karpe that her husband had poured kerosene on her and had set her on fire.
The bench also relied on the statement of the victim’s neighbour Chhaya Bhor who said that she could hear screams coming from the couple’s house.
She had also told the court that she found the house bolted from outside and on opening the door, she found Sunanda in a burnt condition. The accused had burnt her alive and had then left by bolting the door from outside, she said.
“Looking at the facts, we find that there is sufficient material to connect the applicant with the crime, therefore, the application for bail is rejected,” stated the division bench.
