NIA gives nod to discharge plea
The National Investigation Agency (NIA) in its reply before a special court on Thursday did not raise any objection to the discharge applications filed by nine Muslims, arrested in connection with 2006 Malegoan blasts case, stating that the agency could not find any evidence against them.
It filed its reply after the arrested persons filed applications seeking discharge from the case.
“It is submitted that evidence collected by the NIA is not in unison with the evidence collected by ATS and CBI,” the agency said, adding that the court may pass orders.
Earlier, The ATS and CBI had recommended the prosecution of the nine accused for their role in September 8, 2006 explosions that killed 37 people.
The NIA stated that no evidence against the said accused was found in collusion with the final report filed by the ATS and CBI recommending their prosecution.
The NIA found that a Hindu right-wing group was behind the blasts and arrested Lokesh Sharma, Dhan Singh, Manohar Singh and Rajendra Choudhary. Their role came to the fore after Swami Aseemanand, an accused in the 2007 Mecca Masjid blast, made a confession in this regard. On May 22, the NIA filed a supplementary chargesheet against four Hindu activists and also listed several findings that contradicted those of ATS and CBI.
The state ATS had arrested Noorul Huda Samsudoha (28), Shabbir Ahmed Masiullah (41), Raees Ahmed Rajab Ali Mansuri (35), Dr Salman Farsi Abdul Latif Aimi (40), Dr Farogh Iqbal Ahmed Magdumi (38), Mohammad Ali Alam Sheikh (42), Asif Khan Bashir Khan alias Junaid (35), Mohammad Zahid Abdul Majid Ansari (31) and Abrar Ahmed Gulam Ahmed (38). All were granted bail after NIA took over the investigations.
The court has adjourned the case till next month.
