Nooriya acquitted of drug consumption charges
The special NDPS court convicted south Mumbai resident Nooriya Haveliwala for serious charges like culpable homicide and damage to property on Thursday, but acquitted her for consumption of drugs.
The police, while arresting her had claimed that she had consumed alcohol as well as drugs like cannabis.
The police’s claims, however, became controversial and was later vindicated, after her father disputed them. The police’s initial claim was that Nooriya had tested positive for 457 mg of alcohol in her blood, which is nine times the permissible limit. “I am a doctor and can positively state that no one can even stand straight, let alone drive, with that amount of alcohol in their system,” Nooriya’s father Yusuf Haveliwala had at the time told The Asian Age.
The police’s claim ultimately fell through, with a second report showing that Nooriya’s blood only contained 144 mg of alcohol. The development could have helped her secure bail, had additional charges of drug consumption not been slapped against her. Nooriya, however, was acquitted of these charges, on Thursday, with the court ruling that medical and chemical analysis reports did not support the prosecution’s claim.
“The court observes that the percentage while drawing the blood sample was incorrect and necessary precautions were not taken to establish the claim,” judge I.M. Bohari said in his verdict.
The accident had sparked added outrage among civilians and policemen alike as it had claimed the life of a traffic police officer, who was, ironically, enforcing an anti-drunk driving campaign.
