Siddharth college V-P’s CbI probe plea dismissed by hc
In a setback to former Siddharth Law College vice-principal Chitra Salunkhe, the Bombay high court on Wednesday dismissed her application seeking CBI probe into the alleged malpractice due to which IPS officer K.L. Bishnoi cleared his LLB examination without appearing for the practicals.
A division bench of Justices S.C. Dharmashikari and S.B. Shukre while dismissing the plea observed that grounds stated in it were not justified.
Ms Salunkhe in her plea had alleged that the report filed by the then Maharashtra DGP K. Subramaniam, who had conducted an inquiry against seven senior police officers, including ATS chief Rakesh Maria, for reportedly shielding Bishnoi was an “eyewash”.
She demanded investigation by CBI, stating that inquiry by an independent agency would serve the ends of justice.
Ms Salunkhe’s advocate Manjula Rao had then argued that a fair probe by the police against their own colleague couldn’t be expected, and if not CBI then the probe be handed over to the state CID. To this, the court had said that even the CBI draws its local staff of officials from the police. After hearing the arguments, the bench had reserved the order until Wednesday.
The petitioner alleged that the officers “shielded” Mr Bishnoi, a 1985 batch IPS officer accused of clearing the final year LLB examination with the help of the then acting principal I.A. Inamdar without appearing for the practical examination held on March 12, 2005. Mr Bishnoi was then working with the Economic Offences Wing.
Acting on Ms Salunkhe’s complaint against the duo, seven IPS officers had conducted an inquiry into the matter. She later approached the HC seeking action against the senior police officials alleging that they submitted “false” reports.
