A Delhi court denied a man the custody of his teenaged daughter after the girl said she was happy and comfortable with her mother and refused to reside with him. The court said the mother, who is employed in the ministry of defence and with whom the 15-year-old daughter has been residing, has taken good care of the girl and her paramount welfare was not with the father.
“It is established that the respondent (mother) has taken good care of the girl child who is happily leading her life in the company of her mother. As such, I find that her paramount welfare is with the respondent (mother) and not with the petitioner (father),” guardian judge Gautam Manan said.
The court’s order came on a plea by the father, a lecturer at Kashipur in Uttar Pradesh, seeking custody of his daughter alleging that his wife was “cruel” towards her kids and used to mercilessly beat them up.
In his petition to the court, he said he had been married in December 1988 and out of the wedlock, two children were born.
