The ministry of communications in response to the Supreme Court notice on a petition accusing law minister Salman Khurshid of “interfering” in the 2G scam case probe against a particular company, has come in his strong defence saying the opinion of the law ministry was based on understanding of the facts and law.
“The opinion of the law ministry reflects the understanding of facts and law of the author. The investigating agency is not bound by any opinion. It makes its own assessment of the facts and on the basis of its own understanding of the law proceeds in the matter,” communications ministry’s affidavit filed on Tuesday said.
The affidavit affirmed by telecom department director Sita Ram Meena stated that he was making the submission on the basis of “instructions” from the law ministry.
“This opinion did not and was never intended to interfere with the investigation being done by the CBI. The applicant’s plea that interference of an influential minister (law minister) is evident, is baseless,” the affidavit affirmed.
However, the affidavit did not deny the existence of “Annexure-B” supplied by the NGO, Centre for Public Interest Litigation (CPIL) with its application earlier on which the top court had issued notice to the government, Central Bureau of Investigation, Enforcement Directorate and the income-tax department on January 5.
