In a judgment against Reliance Communication (Rcom) a consumer forum has asked it to pay a `6,000 fine to its customer Subash Kharat for causing him mental agony. Mr Kharat had filed a complaint against the company in November 2011 stating that he had approached RCom to switch his services from CDMA to GSM, and in the process, he underwent immense mental stress as the company failed to provide adequate services.
According to Mr Kharat, the company took the request in June 2011 and informed his that the transfer would be completed within five days.
However, after five days, instead of the switch to GSM, his SIM card was deactivated. Mr Kharat then informed the company, but no proper response was given and his SIM remained deactivated for 25 days and due to this, he faced immense professional and mental woes.
While passing orders in the case, the forum maintained that by going through the documents submitted by both the parties, it is clear that there was a fault on the company’s part in failing to provide proper services to its customers, making it liable for the mental as well as the physical stress caused to the applicant.
RCom’s spokesperson said, “We are currently examining the order issued and will decide on the future course of action in consultation with our legal counsel.”
