The Madras high court has pulled up a batch of petitioners who made several claims and counter claims in respect of allotment of land of 1.25 hectares provided by the state government for houseless poor SCs of Valajanagaram village in Ariyalur.
Justice K. Chandru dismissed a batch of more than 90 petitions seeking a direction to the state government to allot plots with equal frontage to them.
“These are very unfortunate litigations where even among the dalits, two groups were fighting over the exact location of their respective plots for more than 16 years,” he said.
When the scheme has been intended to help them and compulsory land acquisition proceedings were initiated by the state after paying compensation from its fund, it was for the petitioners to accept them, said Justice Chandru.
If for any reason, they do not want a particular plot no one can compel them to accept such a plot. They may surrender the same and go for a housing plot with their own funds, he said.
Petitioners have not made out any legal ground for the petitions to be entertained. In the absence of any legal or enforceable rights on the part of the petitioners, the court was not inclined to entertain the petitions, said the judge, adding that there was also no obligation on the part of the state to allot any particular plot to the beneficiaries.
