The Delhi high court has directed a builder, accused of forging the site plan of a flat without the prior mandatory no-objection certificate (NOC) from the MCD, to return the money to a man, who had given the amount in lieu of the flat.
After hearing the plea of the 55-year-old complainant, Subhash Chander, Justice S.L. Bhayana directed the builder, Ajbinder Singh, to hand over the flat with the NOC from the MCD or to return `1.35 crores he had taken from Chander for the flat.
Additional public prosecutor Navin Sharma, appearing on behalf of the state, argued before the court that Chander had given `1.35 crores to Ajbinder for the flat on Rajpur Road in Delhi Cantt area.
Chander had given `26 lakhs in cash and the rest he had given it to Ajbinder through cheques.
“At present, I am not giving any interim protection to Ajbinder. He was directed to return the money or the flat,” Justice Bhayana said in his order.
Chander had found that the site plan of the flat was allegedly forged and the mandatory NOC was not taken from the MCD. He also found that the flat was illegal and the MCD had plans to demolish it.
After receiving a complaint from Chander, the Economic Offences Wing (EoW) of the Delhi police registered a case and investigated the matter.
