A retired judge of the Allahabad high court on Tuesday challenged the summons issued to him by a CBI court in connection with the multi-crore provident fund scam on the ground that the special judge who had passed the order was himself a witness in the case.
Admitting the criminal revision petition filed by Justice R.N. Mishra, who was elevated to the post of a judge at the high court in 2006 from where he retired in 2009, Justice Arun Tandon fixed January 18 as the next date of hearing in the matter. In his petition, Justice Mishra argued the special CBI judge, who had issued the summons on December 22 last year, was himself a witness in the case and hence he should not have passed an order in this connection. Summons have been issued to more than 20 persons in the scam. —PTI
