A city court has asked the Comptroller and Auditor General (CAG), Vinod Rai, and another senior official of the audit body to appear before it as witnesses in connection with the prosecution related to 2G spectrum allocation scam. The order was passed by the court on a private complaint filed by Janata Party president Subramanian
Swamy, in which he had sought directions from the court to treat him as “deemed prosecutor” against former telecom minister A. Raja, who is alleged to have been involved in the spectrum scam causing a loss of `1.76 lakh crore.
In an order passed on Friday evening, special CBI Judge Pradeep Chaddah, had ordered Mr Rai and director in the office of the CAG, R.P. Singh, to appear before it on February 5.
Earlier, on January 7, the court had ruled that the plea of Mr Swamy of becoming the deemed prosecutor against Mr Raja was “maintainable”.
In his prayers before the court, Mr Swamy had wanted that his complaint be taken cognisance of and Mr Raja be summoned. He also wanted that a criminal complaint should be registered against Mr Raja. Apart from him being treated as deemed prosecutor, Mr Swamy had also wanted the court to issue directions to the investigating agencies like the CBI and the Enforcement Directorate to assist him in conducting the prosecution and in further investigations of the case.
In his plea, Mr Swamy had quoted the findings and the contents of the CAG report, in which it was pointed that the government exchequer suffered a loss of `1.76 lakh crores.
