The Supreme Court on Thursday refused to take on record the much talked about affidavit of Gujarat’s senior IPS officer Sanjiv Bhatt against state chief minister Narendra Modi, accusing him of given instruction to administrative and police officers after Godhra train carnage to go “soft” against Hindus.
“That (the affidavit) is not taken on record. We have not commented on it,” a special bench of Justices D.K. Jain, P. Sathasivam and Aftab Alam said while ordering amicus curiae, senior advocate Raju Ramachandran to have a complete analysis of the final report of SIT.
The SIT had examined the role of Mr Modi, several top former and present administrative and police officers on a petition of Zakia Jafri, the widow of slain Congress MP Ehasan Jafri, seeking registration of an FIR against Mr Modi, several BJP and Sangh Parivar leaders, administrative and police officers for their alleged “complicity” in the post-Godhra riots.
Since Ramachandran has yet to assess the report, he submitted that the affidavit of Bhatt “may not be taken on record in the light of the order passed by the bench.”
The top court in the order, gave full authority to the amicus curiae to have “direct interaction” with any witness and include in his report based on the analysis of SIT investigation any “offence” against any person, if left out by the probe team, headed by former CBI director R.K. Raghvan.
