SC asks govt to amend dowry law
In an important ruling on the “misuse” of anti-dowry law to file false complaints in order to settle domestic scores, the Supreme Court on Friday asked the Law Commission and the Centre to seriously consider bringing suitable amendment in the law to prevent its misuse.
A bench of Justices Dalveer Bhandari and K.S. Radhakrishnan directed the apex court registry that their judgement on a “false” case under section 498-A of the IPC, which deals with dowry, should be sent to the Law Ministry and the Law Commission to ponder upon the issue.
“It is also a matter of common knowledge that exaggerated versions of the incident are reflected in a large number of complaints. The tendency of over implication is also reflected in a very large number of (dowry) cases,” the bench observed. “Even ultimate acquittal in the trial may also not be able to wipe out the deep scars of suffering of ignominy. Unfortunately a large number of these complaints have not
only flooded the courts but also have led to enormous social unrest affecting peace, harmony and happiness of the society,” the apex court said, pointing out that how a noble legislation could be misused. The apex court also came down heavily on the fraternity of lawyers, saying many of the “false” cases are in fact registered on their advice to settle the domestic scores.
